Hydraloop Warranty Registration & Terms of Factory Warranty

Introduction Hydraloop Inc. and its affiliated companies (“Hydraloop”) are committed to providing innovative decentralized water recycling solutions and exceptional service worldwide. To affirm our confidence in the quality of our products, each new product is accompanied by a factory warranty. This document outlines the complete terms, conditions, and procedures of this warranty and is accessible via the owner app.

Warranty Activation The warranty for your Hydraloop product will commence automatically on the date of first-time commissioning after installation, which is defined as the date when the product has been installed, tested, and certified as operational by an authorized technician. Commissioning must occur within six (6) months of the product’s delivery to the owner. If commissioning is delayed beyond six months, prior written approval from Hydraloop is required. In such cases, the warranty period will begin on the product’s delivery date and may be reduced at Hydraloop’s discretion to account for the delay in commissioning. When commissioning is completed within the required timeframe or with Hydraloop’s approval, the warranty will remain valid for a term of two (2) years starting from the commissioning date.

Warranty Coverage Hydraloop warrants to the original owner of the product (“Owner”) that the product will be free from material defects for the duration of the warranty period. A material defect refers to a manufacturing or design fault that significantly impacts the product’s functionality and is attributable to Hydraloop.

Owner Responsibilities in Case of Defects If a defect is identified, the Owner must:

  1. Cease using the product immediately unless instructed otherwise by Hydraloop or a local service partner.
  2. Submit a warranty claim through the app or by contacting a local service partner within fourteen (14) days of identifying the defect to allow for reasonable reporting time.
  3. Allow Hydraloop or its authorized representatives to inspect the product within ten (10) business days of receiving the claim.
  4. Follow all instructions provided by Hydraloop or its local service partner.

Warranty Remedies For valid claims:

  1. Hydraloop will provide repair services or replacement parts at no cost to the owner. This includes both parts and labor if the owner has an active Hydraloop maintenance agreement.
  2. If necessary, the product may be replaced with a similar model.
  3. Any replacement part or product provided under the warranty will continue to be covered for the remaining term of the original warranty or six (6) months, whichever is longer.
  4. If no maintenance agreement is in place, labor costs for warranty-related repairs may apply, but replacement parts will still be provided free of charge.

Restrictions and Exclusions The warranty will only apply if:

  • The product has been installed, maintained, and used according to Hydraloop’s guidelines as outlined in the installation manual and owner manual.

This warranty excludes damages resulting from:

  1. Normal wear and tear, including routine maintenance needs.
  2. Improper installation, maintenance, or use, particularly if contrary to the installation manual or owner manual.
  3. Unauthorized modifications, repairs, or use of non-Hydraloop-approved parts or components.
  4. External events such as natural disasters, vandalism, or other force majeure circumstances.
  5. Deliberate or negligent misuse of the product.

Warranty Term The duration of the warranty is two (2) years, starting from the date of first-time commissioning after installation. Commissioning must be completed within six (6) months of product delivery to activate the warranty. If commissioning occurs after six months without prior written approval, the warranty period may be shortened and will begin on the product’s delivery date. Owners should retain proof of commissioning, signed by an authorized technician, as part of their warranty documentation.

Disclaimer This warranty replaces all other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Hydraloop’s liability is limited to repair, replacement, or refund, as outlined in this document.

Limitation of Damages Hydraloop is not liable for indirect, incidental, or consequential damages arising from the use of the product.

Jurisdiction The applicable jurisdiction for disputes under this warranty will depend on the location of the customer:

  • North America: This warranty is governed by the laws of the State of New York, USA. Disputes will be resolved under the International Arbitration Rules of the American Arbitration Association, with arbitration conducted in English in New York, New York.
  • Rest of the World: This warranty is governed by the laws of the Netherlands. Disputes will be resolved under the Arbitration Rules of the Netherlands Arbitration Institute, with proceedings conducted in English in Amsterdam, Netherlands.

Hydraloop encourages customers to resolve minor disputes through direct communication with a local service partner to facilitate a quick and amicable resolution.
